The trial of former city councilor Jairo Souza Santos Júnior, accused of the death of the boy Henry Borel, took a new turn this Monday (26). One of the defense lawyers, Sergio Figueiredo, announced his resignation from the case during the session of the Jury Court, in Rio de Janeiro.
The criminal lawyer stated that he decided to withdraw from the defense because he disagreed with the continuation of the trial after the heart attack suffered by lawyer Fabiano Lopes, the longest-serving member of Jairinho's team, according to reports. UOL.
Figueiredo stated that the group had requested a postponement of the session, but the requests were not accepted by the court. "I don't agree with what's happening," the lawyer declared as he left the court.
Defense criticizes continuation of trial.
According to Sergio Figueiredo, maintaining the jury trial represents "irresponsibility and disrespect" towards Fabiano Lopes, who fell ill last Saturday and was unable to continue his defense work.
The lawyer argued that postponing the proceedings for a few months would not harm the process. "It wouldn't make any difference to wait another one, two, or three months. Society would get an answer, whether it's a conviction or an acquittal," he told reporters outside the courthouse.
He further stated that the absence of Jairinho's main lawyer directly compromises the defense strategy. "Imagine taking the main lawyer and removing him. What's left?" he questioned.
The request for postponement was denied.
Sergio Figueiredo revealed that he submitted 23 requests related to the trial, but none of them were accepted by the court. The decision to proceed with the session provoked a strong reaction from the former councilman's defense team.
The trial takes place five years after the death of Henry Borel, a case that had widespread national repercussions. Jairinho is facing charges related to the boy's death and is attending the jury trial at the Rio de Janeiro Jury Court.
The departure of one of the lawyers in the middle of the session adds further tension to the trial, which had already been marked by requests from the defense and debates about the conduct of the proceedings.
