The majority of judges at the Regional Electoral Court (TRE-RJ) of Rio de Janeiro followed the rapporteur Cláudio Dell'Orto and voted for the ineligibility of the mayor of Rio, Marcelo Crivella (Republicans), in a session this Monday (21).
Judge Vitor Marcelo Rodrigues requested to review the case and will conclude his vote on Thursday (24), when the trial will be finalized. The action concerns an event at Comlurb in which Marcelo Hodge Crivella, Crivella's son, was presented as a pre-candidate for deputy.
The rapporteur of the case also stated that Crivella's impeachment is not appropriate and determined that the charges were upheld:
abuse of political power
prohibited conduct
maximum fine of R$106 thousand
The lawsuit was filed by the PSOL and the Regional Electoral Prosecutor's Office (PRE). The meeting took place at Estácio de Sá's block with Comlurb employees. They were transported in official company vehicles.
The mayor is running for reelection and can run until all appeals are exhausted—that is, until the case is finalized. He could still take the case to the Superior Electoral Court (TSE) and the Supreme Federal Court (STF).
The following were also found guilty:
Marcelo Hodge Crivella
Alexander Costa
The request from the PSOL and the Prosecutor's Office also sought ineligibility for the episode that became known as "Fala com a Márcia," but the judges saw no irregularity.
